New Mexico will continue to collaborate with the NAIC and interested parties in the evolving adjuster community. Changes to the New Mexico Administrative Code (NMAC) 13.4.8 take effect April 1, 2025, and OSI understands the time allocated for meeting compliance is unlikely, therefore this requirement will begin to be enforced upon renewal licenses with an expiration date of April
2026 and ongoing.
Requirements for individual nonresident adjusters:
- Must have an Active resident or DHS license, prior to applying with our department.
- Only eligible for the same License type and Lines of Authority held in Resident State. (A background check is NOT required for this license type, unless New Mexico is going to be the individual’s DHS license.)
- Must have a resident license in the home state, if not, must select an acceptable DHS jurisdiction
- State must require a passed examination.
- State must have CE requirement – If the resident state issues the license but does not have a CE requirement, the adjuster can complete the education with an approved NM provider or with an approved state.
- The following states do not have a CE requirement for adjusters and therefore cannot be
selected as a DHS. NM will not accept a DHS from: AZ, CT, HI, ME, MI, NY, SC, VT.
- If you live in a state that does not issue adjuster licensing, you will be required to have a DHS.
- NM will accept the following states as DHS option for applicants whose resident state does not license adjusters. AL, AR, FL, ID, IN, KY (only for IA), LA, MN, MT, NH, NC, NV, OK, TX, UT, WA, WV, WY
